Administrative Review Officer

The City of Moose Jaw is dedicated to a responsible, fair and transparent government and the provision of efficient, effective and affordable municipal services.

When a citizen feels he or she has not been treated fairly by City Administration, it is important that we address that concern. For this reason, the City of Moose Jaw has established an administrative review procedure administered through the Moose Jaw Administrative Review Office. The Review Officer is independent of City Administration and reports directly to City Council.

The Administrative Review Officer is appointed by City Council. People interested in the position submit their names and resumes following a call for nominations. A report is then forwarded to Council who votes to select the person for the position. This was done in a report to Council (Communication# 12) dated February 5, 2009. Four people applied and Mr. Lloyd Hackel was selected. Mr. Hackel's term is March 1, 2009 to December 31, 2010, or until a successor is appointed.

Any person (or group of persons), affected by a matter of City Administration or by a decision of any department or agency of the City, may ask that a complaint be investigated by the Review Officer. Complaints must be in writing and must contain sufficient information to allow a proper investigation. Complainants are assured that, although all complaints are a matter of public record, the particulars of a complaint will be kept confidential. Nonetheless, complainants need to be aware that the general nature of a complaint will be a matter of public record.

Written complaints are delivered to the City Manager, who transmits the complaint to the Review Officer, together with a copy to the appropriate department. The Review Officer will investigate the complaint and, in doing so, has broad authority to interview witnesses, take statements and examine City files and corporate records, as necessary.

During the course of investigating a complaint, the Review Officer has authority to attempt to resolve the concerns raised through negotiation, conciliation or mediation. For obvious reasons, the Review Officer also has authority to refuse to investigate frivolous complaints.

Complainants are cautioned that certain matters are beyond the authority of the Review Officer to investigate. These include:
  1. any decision, recommendation, act or omission of:
    1. City Council;
    2. a Standing, advisory or other committee established by City Council;
    3. the board of a controlled corporation of the City;
    4. a person acting as a lawyer for the City.
  2. any matter for which:
    1. an appeal process is already established by Act or law (such as matters within the jurisdiction of the Development Appeals Board, the Board of Revision and the Property Maintenance Appeal Board);
    2. a more appropriate forum exists to investigate and hear that complaint (such as through the Saskatchewan Police Complaints Investigator).
Complainants are cautioned that the Review Officer is prevented from investigating any matter after the expiration of twelve months from the day on which the complainant should have been aware of the incident complained of.

The findings and recommendation of the Review Officer is reported directly to City Council, through its Executive Committee. Final disposition of a complaint, if it has not already been resolved through other means, will be at the discretion of City Council.

Persons wishing to file a formal complaint with the Review Officer are asked to pick up a Complaint Form from the City Manager's Office, 2nd Floor of City Hall, 228 Main Street N., Moose Jaw, Sk.
